    Yeah cause a contract breach takes just as long to prove a IP suite. They'd get slapped so fast they wont know what hit them, not to mention other companies would see it as samsung being cowboys for mixing their two business up.

    but there are ways to make Apple life hell and cause huge amounts of problems with out breaking the contract.

    Examples are shipments get delayed. Takes longer to process orders.
    Apple needs to rush order something and get it quickly..... Guess what not going to happen.
    I have seen the back world of things like this. Samsung can do a lot with out breaking the contract. Apple is gaining a reputation not to be trusted in any way shape or form.

    I hope iPhone will have a good sync with the Mac. If i am only looking for a pretty cell phone, there are a lot in the japanese market.

    What about the Container Store, which is trademarked? Seems like the difference is whether or not the term is in common use before the trademark is filed.

    I'm not disagreeing with you, but can you, (or anyone,) provide a link to something showing "Container Store" is TMed?

    I had no trouble getting an unlock code from Cingular for a SLVR I bought from them. Here's pix I just took showing it in use back home on the Telstra network.


    I ended up doing the reverse. I bought a SLVR in China and brought it back to the USA. It's so nice not to have to be on any ****ing "contract". (Sorry, I just really hate the state of the cellphone market in the USA.)

    I just want WiFi VoIP phones to come along and wipe out the whole market...I think that will have to wait for WiMax rollouts nationwide, though.

    As for the Senator's request, they cannot be required to take it down. If cops are so overt that apps can bust their checkpoints, maybe they should be floating checkpoints?

    It's illegal. Police need to publicly announce check points before setting up. Ironic they would want to pull the app since this is the basis that makes them legal in the first place.

    Still they store it and can access it - nobody except my touches my iPhone and my Laptop. I actually enjoyed looking at the map. Nobody can access it on they fly on the road.

    I bought a movie (Good Will Hunting) to try out the whole shabang and see the quality for myself. The 1.5Gb download took 6+ hours on my crappy adelphia cable modem (it feels slower every day, what am I paying 50 bucks a month for again?). I was satisfied with the image quality on my 20" Dell widescreen, but sitting at my desk to watch a movie instead of my couch isn't the movie experience I'm going for. Sadly, I probably won't be buying another iTunes movie.

    Not that anyone cares.

    That can be viewed another way. Apple is too cheap to bother risking anything that is not a sure bet.

    MS willing to risk R&D and a lot of R&D on things that might be a dead end.
    MS R&D is more like a university Research compared to Apple R&D that is only about profit.
    Guess which one adds more better for the people. Correct answer is not Apple

    Man, if those success stories were sure bets, how come nobody went for it long before Apple?

    No win situation to continue with the lawsuits.

    The patent could be invalidated I'm certain.

    However look at the speed that the patent office displayed in dealing with the NTP patents that Blackberry infringed upon. Glacial. That cost RIM $450m, plus the lawyer fees, that's the cost of staying in business for them, a halt to sales and service would have killed them.

    By the time the patent office would have invalidated the patents (2010 say), Creative would have won the court case (previous look and feel cases notwithstanding) and the damages could have been a lot higher. A small payment (for Apple) and the problem is gone, the worry is gone, the lawyer fees for a court case won't happen, no uncertaintly, and I'm sure that the deal also includes a 'no more lawsuits' condition. It probably is the best deal in terms of shareholder value. Instead the final deal does appear to be a win/win situation for both companies.

    Chalk up another win for the broken patent system though.

    We waited 334 days for this? That is how long we went without an iPod update, by far the longest gap in updates, and all we get is larger storage capacity and a few new games?

    In the past 2 quarters, for the first time since Apple introduced the iPod, iPod sales have declined. Last quarter, Apple sold just over 8 million iPods, down from a peak of over 14 million 2 quarters ago. The reason is because people bought new iPods, and there was no reason to replace them because it took Apple so long to update the models. Now, after all of the wait (nearly a year) and speculation about 16x9 video iPods, touch-screen controls, wireless capabilities, etc., I think this update will go mostly unnoticed to consumers and iPod sales will continue to fall. Apple needs to drastically change and improve iPod offerings if it wants to maintain its market advantage and keep the iPod fashionable.

    The fact you seem to miss is that the Nano is by far the biggest selling iPod. And they did a pretty nice update to it, what more would you want in that model? They definitely will update the "big" ipod at some point, but there are some MAJOR technological hurdles to overcome, especially battery life for video and the no-touch interface. We'd all love to see it, but apple really needs to take their time and get it right if it's truly going to be groundbreaking.

    iPod w/video sales probably won't do much (except for the price drop, which is pretty nice), but nanos and shuffles should sell like mad. I'd be shocked if iPod sales don't spike back up again.

    I just checked on the Apple site, and there isn't a new iPod updater to include the new software updates for the original 5G iPods.

    I thought updates were now going to be handled by iTunes. Maybe the updates haven't been made available to it online yet. After all, iTunes and QT haven't showed up in software update either.

    Edit: The REAL question is have they updated iTunes to be a better video player? I hate watching TV or movies in the current version.

    There definitely are new video features, although you'll have to see for yourself if your specific complaints are addressed.

    They still can. Apple can turn around tomorrow and buy Creative for what it's worth and would have in essence paid itself the $100M. :D

    in a corporate acquisition, there's a purchase price, and at settlement the buyer pays the purchase price plus the value of assets such as cash, so the scenario you describe, while possible, is not likely the way it would unfold. imho.

    and what exactly is the gapless playback...I guess I missed that. Im a little disappointed by the conference...i mean the new iTV isnt even available until next year...blah

    "Gapless" means no more little micro-pauses between tracks. You'd only notice it if you were listening to a live album or something like "Abbey Road" where the tracks segue into one another.

    1st of all I said Apple not IBM or AMD. AMD is going to get a through ass kicking for the next 12-18 months till K8L comes out. The Turion X2 is a flop(that's also 6 months late) It's so bad for AMD that they are practically having a fire sale on X2/A64's come the 24th. Let's not even go there with IBM they are too busy making toy CPU's for M$ , and talk about the nightmare IBM/Sony are having with the Cell yields(what are they like 20-30%).lol:D
    I got do a firmware upgrade and get on that X2 sales action. I just hope it will be fairly priced like the non X2's.

    and since steve compared osx to windows and the mac pro to dell and made lot's of fun about both they'd better stay on top of the game.

    I think that Apple shouldn't enter that race.. their products are distinguished by other features than mere processing power (as soon as this changes: goodbye Apple), and coming out with new models every few months will probably just piss off Apple customers (so far, it's pretty easy to know ALL current laptop models that Apple offers - can you say that for Dell, too?).

    I admire your commitment to the evolutionary approach. I would just like to point out that evolution has also created the compassion (or at least social conscience) that inspires this sort of effort. Perhaps this compassion is a trait that increases the survivability of our species in a way too. (I'm not suggesting that all traits increase survivability, but evolution has been going for some time now, and compassion has been a human trait for some time as well, so perhaps the two are friends for some reason).

    Compassion I think is an emergent phenomenon and I think there is an simpler explanation to your "quest" or debate here. What about individual wanting to create a nurturing environment (society) and helping others in time of need is a result of this behavior. Consequently, we construct a positive nurturing environment that is the "best" environement to raise our children (offspring). I think the new field of evolutionary psychology provides a very useful tool of looking human behavior.

    That's quite true.

    Using your STD example, I have zero need for protection if my wife and I are exclusive with each other, as we are. Likewise, protection isn't currently necessary for a Mac if the user exercises reasonable care and caution. If you want to run AV on your Mac, it's perfectly within your right. It's just not needed for protection.

    You alone have the power to stop reading or posting in this thread.

    It's not turning a mountain into a mole hill to stand by accurate, factual statements when they're challenged. It's not a "status-quo"; it's the current reality in the Mac computing world. No one is saying that it couldn't change in the future. It just hasn't yet.

    You have no idea what attitude "most Mac users" have, unless you've interviewed the many millions of them. If I exercise the reasonable care that I've already described, it can't happen to me, in the current computing environment. If that situation ever changes, such as the introduction of a true Mac virus into the wild, any antivirus app I may have installed today will provide no protection from that event.

    It's called "profit motive", which any successful company has.

    Again, a personal opinion. Like millions of others, I find their hardware options perfectly acceptable and I don't have a problem with their pricing. If that weren't true, I and millions of others simply wouldn't buy from them.

    No one is suggesting that you shouldn't be careful. In fact, that's exactly what we've been saying: if you're careful, you don't need antivirus software to protect your Mac from malware.

    I think GGJstudios answered MagnusVonMagnum's contentions, misrepresentations and straw-man arguments perfectly. And Magnus, I hope that you're truly sick of this thread, because I am too with your belaboring the same points, putting words in peoples' mouths and contributing nothing to this thread.
